The applicable regulations, in most of these cases, are contained in Law 15/2007 on the Defense of Competition and Law 3/1991 on Unfair Competition . This legislation must be studied and interpreted in accordance with the case law standards found in Spanish and European courts.
Competition law can be exercised through two channels: administrative and commercial.
Firstly, either the National Competition Commission or the delegated bodies of the Autonomous Communities are authorized to investigate and sanction conduct that violates competition law. In this case, the proceedings are usually formalized through an administrative procedure that requires optimal legal representation and can be appealed to the courts.
Secondly, any interested party can file lawsuits in the competent Commercial Courts to penalize actions by other companies that violate competition law, and may also seek appropriate compensation. These legal proceedings, which require mandatory representation by a lawyer and a court agent, result in a court ruling that may (or may not) order the company in question to refrain from certain actions and to pay the required compensation.
